BOOKING TERMS and CONDITIONS
The Rental Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into as of the Reservation Date written below by and between the undersigned person(s) or company (the “Guest”) and the undersigned Owner, Manager or Agent (“Rental Agent”), pursuant to which the Guest has agreed to rent the residence described below (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein. By booking your holiday with The Ferns Cottage you agree to the following Terms and Conditions. Please read carefully.
PAYMENT
A Deposit Cheque or BACS payment (non-refundable) of £126 is payable upon Booking.
We will then send you a confirmation of your Booking by post or email. The balance of £504 is then due 21 days before your arrival date.
CONDITION AND USE OF PROPERTY
The Property is provided in an “as is” condition. The Rental Agent shall use his/her best efforts to ensure the operation of all the amenities in the Property, including but not limited to internet access, cooking, refrigeration, heating, shower, washing & drying facilities. The Rental Agent shall not be held responsible for such items failure to work but will make every effort to correct any issues that are reported as quickly as possible. The Guest acknowledges that use of the amenities, may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest’s own risk. Guests shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in a clean and sanitary condition at all times. Guests and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger or inconvenience neighbours. Nor shall Guests use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.
DEFAULT
If the Guest should fail to comply with the conditions and obligations of this Agreement Guests shall be requested to surrender the Property, remove all Guest property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.
CANCELLATION AND INSURANCE
Once you have booked your holiday, our agreement with you is a legal contract. If you cannot go on holiday and the Cottage cannot be re-let, you are liable to pay for the booking in full. If we succeed in re-letting the Cottage for that same period, we will refund to you any such rentals received less your deposit, which is always non-refundable. For these reasons we strongly recommend that you take out travel insurance for your holiday.
NON-AVAILABILITY OF COTTAGE AS BOOKED
We would only cancel your holiday if the Cottage was unavailable for reasons beyond our reasonable control. We would attempt to offer you alternative accommodation. However, if this was either not possible or not acceptable to you then we would refund to you all monies paid for the holiday. Our liability to you would not extend beyond this refund.
ARRIVAL
Directions to the Ferns Cottage and the Key Safe security number will have been sent to you upon receipt of your balance. The Ferns Cottage will be ready for you from 4pm on the agreed date of your arrival, unless otherwise agreed in advance.
DEPARTURE
Checking out time is 10am on the agreed day of departure. Please ensure you have secured The Ferns Cottage upon vacating and have left the keys in the Key Safe by the front door. Our Housekeeper will be wanting to gain access at this time. Leaving after 10am will incur a late departure fee of £25.
LIABILITY
We do not accept responsibility for injury to persons or loss / damage to possessions unless caused by a proven negligent act or omission by ourselves, our employees/contractors or agents of the same whilst acting in the course of their employment. This includes loss or damage to vehicles and their contents and to the personal possessions that you bring with you.
RELEASE
Guests hereby waive and release any claims against the Rental Agent, the Property Owner and their successors, assignees, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guests on, near or adjacent to the Property, including any common facilities, activities or amenities. Guests agree to use any such facilities or amenities entirely at Guests own initiative, risk and responsibility.
COMPLAINTS
Should you find any faults or have any complaints during your stay, please advise us immediately so that any appropriate action can be taken. Any unresolved disputes may be referred to arbitration.
DAMAGE AND BREAKAGES
You are responsible for any breakages or damage that you cause to The Ferns Cottage and its contents. A list of replacement value is available on request. Please report all breakages or damage before you leave.
WEBSITE and BROCHURE
We make every effort to ensure that the information and the description of The Ferns Cottage contained on our Website, and the accompanying brochure, are accurate. We do, however, reserve the right to make small changes and we accept no liability for minor inaccuracies.
SMOKING – PLEASE READ CAREFULLY
To comply with current legislation The Ferns Cottage is STRICTLY NON SMOKING.
Anybody found smoking inside the building will be asked to leave immediately. Smoking is permitted in outdoor areas but we would ask that cigarette stubs are to be retained by yourself/selves and disposed of safely and not inside The Ferns Cottage or on the ground or flower beds adjacent to the Cottage. Any damage caused by cigarettes and/or smoking will be charged to cover the cost of the damage caused.
PETS
PETS are permitted to stay with their Owners at The Ferns Cottage. However, pets are not to be left in the cottage unattended. An additional deposit of 20% will be charged for Guests wishing to bring pets and this will only be refunded after departure once the property has been checked for damage by the Housekeeper. Any damage identified will be notified to the Guest and the cost of repair and/or rectification shall be notified.
VEHICLES
All vehicles are parked at their Owners risk and we accept no responsibility or liability for any damage or loss incurred to either vehicles or their contents whilst on our property.
GENERAL PROVISIONS
This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the Guest and the Rental Agent. The words “Rental Agent”, “Guest” and “Guests” shall include their respective heirs, successors, representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waiver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein. This Agreement may be signed in one or more counterparts, each of which is an original, but taken together constitute one in the same instrument. Execution of a digital signature shall be deemed a valid signature.
